Recommendations of Maharashtra Govt for Governor nominated membership of the state Legislative council kept pending for last one month

It is important to note that, CM Uddhav Thackeray had sent a recommendation for filling up the vacancy of 2 seats arisen in the governor nominated membership of the state legislative council. The government had recommended the names of Shivajirao Garje, General Secretary of the State NCP and a retired bureaucrat alongwith Miss Aditi Nalawade, Convenor of Mumbai NCP Yuvati wing and Social Media cell. With more than a month elapsed since the recommendation  the governor is yet to take a decision and issue orders. This information has been provided to RTI Activist Anil Galgali by the Governor's Secretariat. It is significant to note that, the Governor has to nominate members who should possess knowledge and experience in the  catagory of a Litrateur, Science, Arts, Cooperative sector and Social service. With the Governor being undecided, it is expected that this could be a break on nomination of political persons under this quota. 

RTI Activist had sought information from the Governor's Secretariat, about the decision taken in the case of recommendation from the government regarding nomination of NCP's Shivajirao Garje and Aditi Nalawade. The Public Information Officer and Under Secretary (Administration) of the Secretariat, informed Galgali that, since the decision taking procedure has not been completed on the recommendations made by the government, the copy of the decision cannot be provided. Further on the query about the Rules and conditions of nominations, they informed that, under Art 171(5) of the Indian Constitution, persons possessing special qualifications and experience related to the field of Literature, Science, Arts, Cooperative fields and Social service can be nominated as Members of the Legislative council. The Nomination has to be done on the recommendations received from the state government. Any other rules or conditions apart from the above is not in the knowledge of the Secretariat. 

In a letter addressed to Governor Bhagat Singh Koshiyari and CM Uddav Thackeray, Anil Galgali has appealed that political persons should not be nominated on the seats meant to be reserved for persons having special abilities in the field of Literature, Science, Arts, Cooperative sector and social service. Only persons belonging to the fields recommended should be considered.
